Terms of Service
Last updated:
These Terms of Service (“Terms”) govern access to and use of the Frontmail service, website, APIs and SDKs (together, the “Service”) provided by [OPERATOR NAME, ADDRESS, ID] (“Frontmail”, “we”, “us”). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind it.
1. The Service
Frontmail lets you send email from websites, apps and servers through email services you connect (for example SMTP, Gmail, Outlook or a transactional provider). You remain the sender of every message; we process messages on your instructions.
2. Accounts
- You must provide accurate information and keep your credentials, API keys and multi-factor devices secure.
- Public keys are designed for browser use and are protected by domain allowlists, CAPTCHA and rate limits you configure. Private keys must never be exposed in client-side code.
- You are responsible for all activity under your account and organisation, including actions of invited team members.
3. Plans, credits and payment
- Subscription plans include a monthly email quota. Unused quota does not roll over.
- Credit packs are one-off purchases valid for the period stated at purchase. Unused pack credits expire at the end of that period and are not refundable except where required by law.
- Paid plans include an overdraft buffer. Overdraft credits used in a billing period are charged on the next invoice at [OVERDRAFT UNIT PRICE].
- When no credits are available, messages are held (or rejected, if you choose that mode) as described in the documentation. Held messages that are not released before the hold period ends are discarded after we notify you.
- Prices are shown without VAT. Taxes are calculated at checkout. Payments are processed by Stripe.
- Upgrades take effect immediately with proration; downgrades and cancellations take effect at the end of the current billing period.
- [Consumer withdrawal rights, refund policy and invoicing details to be completed after legal review.]
4. Acceptable use
You must comply with our Acceptable Use Policy. We may suspend or limit the Service to protect recipients, providers or the platform, and will notify you unless doing so would be unlawful or undermine the protection.
5. Your content and data
You keep all rights to your templates, contacts and messages. You grant us the rights needed to operate the Service. Where we process personal data on your behalf, our Data Processing Agreement applies. Our own processing is described in the Privacy Policy.
6. Third-party services
The Service relies on email providers you connect and on infrastructure providers. We are not responsible for the availability or conduct of email providers you choose, including their delivery decisions.
7. Availability and changes
We aim for high availability but do not guarantee uninterrupted operation unless agreed in a separate service level agreement. We may change the Service; material changes to these Terms will be announced at least [30] days in advance.
8. Liability
[Limitation of liability, warranties and indemnities – to be drafted by counsel. Consumer protection rules that cannot be excluded remain unaffected.]
9. Term and termination
You may close your account at any time from the dashboard. We may terminate for material breach after notice. After closure we delete your data as described in the Privacy Policy; you can export your data before deletion.
10. Governing law
These Terms are governed by the laws of [JURISDICTION]. Courts of [VENUE] have jurisdiction, without prejudice to mandatory consumer protection rules.
